00HOUSE BILL NO. 76 01 "An Act making a special appropriation to the Department of Natural Resources 02 for the purchase of the inholdings of the Seldovia Native Association and the 03 Cook Inlet Region, Inc., and the timber rights of the Timber Trading Company, 04 within the Kachemak Bay State Park; and providing for an effective date." 05 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 06 * Section 1. LEGISLATIVE FINDINGS. The legislature finds that the Kachemak Bay 07 State Park is an important scenic and recreational area and that the inholdings within the park, 08 if developed, would seriously compromise the integrity of the existing park land. The 09 legislature finds, therefore, that it is in the interest of the state to acquire the inholdings of the 10 Seldovia Native Association and the Cook Inlet Region, Inc., and the timber rights of the 11 Timber Trading Company, within the Kachemak Bay State Park. 12 * Sec. 2. In order to achieve the purposes of the remedial and compensatory payments, the 13 sum of $7,000,000 is appropriated from the remedial and compensatory payments to the 14 Department of Natural Resources for the purchase of the inholdings of the Seldovia Native

01 Association and of the Timber Trading Company, within the Kachemak Bay State Park as 02 identified in the Preliminary Exchange Agreement dated June 30, 1989, as amended as of the 03 effective date of this Act, between the state, the Seldovia Native Association, and the Timber 04 Trading Company; and for the purchase of the inholdings of the Cook Inlet Region, Inc., 05 within Kachemak Bay State Park. 06 * Sec. 3. In this Act, "remedial and compensatory payments" means the remedial and 07 compensatory payments received by the state under the criminal plea agreement between the 08 United States and Exxon Corporation and Exxon Shipping Company in the United States of 09 America v. Exxon Corporation and Exxon Shipping Company, United States District Court, 10 District of Alaska, case No. A90-015 CR and held in trust by the state treasury in a trust 11 account in the general fund. 12 * Sec. 4. The unexpended and unobligated balance of the appropriation made by this Act 13 lapses into the account in the general fund from which it was appropriated December 31, 14 1994. 15 * Sec. 5. This Act takes effect immediately under AS 01.10.070(c).
