01 Proposing amendments to the Constitution of the State of Alaska relating to forward                                     
02 funding of public education for grades kindergarten through 12.                                                         
03 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                               
04    * Section 1. Article IX, sec. 12, Constitution of the State of Alaska, is amended to read:                         
05 Section 12. Budget. (a) The governor shall submit to the legislature, at a time                                   
06 fixed by law, a budget for the next fiscal year setting forth all proposed expenditures                                 
07 and anticipated income of all departments, offices, and agencies of the State. The                                      
08 governor, at the same time, shall submit a general appropriation bill to authorize the                                  
09 proposed expenditures, and a bill or bills covering recommendations in the budget for                                   
10       new or additional revenues.                                                                                       
11    * Sec. 2. Article IX, sec. 12, Constitution of the State of Alaska, is amended by adding a                         
12 new subsection to read:                                                                                                 
13 (b)  A budget submitted under (a) of this section shall include proposed                                                
14 expenditures to fund public education for grades kindergarten through twelve for the                                    
15 fiscal year following the fiscal year for which the budget is prepared. A general                                       
16 appropriation bill submitted by the governor and passed by the legislature shall                                        
01 include an appropriation to public education for grades kindergarten through twelve                                     
02 for distribution in the fiscal year following the fiscal year for which the budget is                                   
03       prepared.                                                                                                         
04    * Sec. 3. Article XV, Constitution of the State of Alaska, is amended by adding a new                              
05 section to read:                                                                                                        
06 Section 30. Education Funding: Transition. (a) The 2020 amendment                                                     
07 requiring forward funding of public education (art. IX, sec. 12(b)) takes effect thirty                                 
08 days after the lieutenant governor certifies that a majority of the votes cast on the                                   
09 proposition in the general election were in favor of the amendment unless, before                                       
10       certification, the legislature has failed to enact an appropriation bill to fund public                           
11       education for grades kindergarten through twelve for fiscal year 2022.                                            
12            (b)  If the amendment does not take effect under (a) of this section, the                                    
13       amendment takes effect on the earlier of                                                                          
14                 (1)  the date the legislature enacts an appropriation bill to fund public                               
15       education for grades kindergarten through twelve for the fiscal year succeeding the                               
16       fiscal year for which the budget is prepared; or                                                                  
17                 (2)  January 1, 2026.                                                                                   
18    * Sec. 4. The amendments proposed by this resolution shall be placed before the voters of                          
19 the state at the next general election in conformity with art. XIII, sec. 1, Constitution of the                        
20 State of Alaska, and the election laws of the state.
