01 "An Act relating to fees for using an automated teller machine; and providing for an                                    
02 effective date."                                                                                                        
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
04    * Section 1. AS 06 is amended by adding a new chapter to read:                                                     
05                    Chapter 90.  Miscellaneous Provisions.                                                             
06 Sec. 06.90.010. Automated teller machine fee. Unless a fee is otherwise                                               
07 prohibited by or conflicts with federal law, a person that owns an automated teller                                     
08 machine may charge a fee for the use of the automated teller machine to conduct a                                       
09 transaction accessing an account from an international financial institution. In this                                   
10       section,                                                                                                          
11                 (1)  "automated teller machine" means an electronic device that                                         
12       dispenses cash in connection with a credit, deposit, or checking account at an                                    
13       international financial institution;                                                                              
14                 (2)  "international financial institution" means a person that is                                       
01       organized and licensed under the laws of a foreign country to engage in a banking                                 
02       business; in this paragraph, "banking business" means a business that offers deposit                              
03       accounts, makes loans, and conducts other financial transactions.                                                 
04    * Sec. 2. This Act takes effect immediately under AS 01.10.070(c).
