00 SENATE BILL NO. 103 01 "An Act establishing the Alaska education innovation grant program; eliminating the 02 Alaska education grant program and the Alaska performance scholarship program; 03 redesignating the Alaska higher education investment fund as the Alaska education 04 innovation grant fund; and providing for an effective date." 05 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 06  * Section 1. AS 14.03 is amended by adding a new section to read: 07 Sec. 14.03.128. Alaska education innovation grant program. (a) An 08 innovation education grant program is established in the department. School districts 09 may request a grant under this section for the support of innovative education ideas, 10 including 11 (1) programs that change the method of interaction between students 12 and teachers in the classroom; 13 (2) instruction delivered through a combination of technologies, such 14 as video, interactive software, games, social media, and print media; 01 (3) pilot projects that support teachers and students by using a variety 02 of educational resources to bring new instructional approaches into classrooms in the 03 state; and 04 (4) other programs designed to achieve best practices for education as 05 identified by the commissioner. 06 (b) The commissioner shall annually determine the amount requested for 07 grants under this section and shall include the amount in the department's budget 08 request. The legislature may appropriate funds from the Alaska education innovation 09 grant fund established under AS 37.14.750 for the awarding of grants under this 10 section.  11  * Sec. 2. AS 14.42.030(e) is amended to read: 12 (e) The commission may 13 (1) adopt regulations under AS 44.62 (Administrative Procedure Act) 14 to 15 (A) carry out the purposes of 16 (i) AS 14.43.091 - 14.43.325, 14.43.510 - 14.43.750 17 [AS 14.43.091 - 14.43.849], 14.43.990, AS 14.44, and AS 14.48; and 18 (ii) AS 14.43.910 and 14.43.920 as they relate to the 19 purposes of AS 14.43.091 - 14.43.325, 14.43.510 - 14.43.750 20 [AS 14.43.091 - 14.43.849], 14.43.990, AS 14.44, and AS 14.48; 21 (B) ensure compliance with the requirements imposed by state 22 and federal statutes and regulations governing the guaranty, insurance, 23 purchase, or other dealings in eligible loans by federal agencies, 24 instrumentalities, or corporations; and 25 (C) establish standards for the 26 (i) administration of hearings conducted under 27 AS 14.43.153; and 28 (ii) administrative enforcement of collection orders 29 under AS 14.43.151 - 14.43.155; 30 (2) delegate to the executive director of the commission or a 31 subcommittee of the commission any duty imposed on or power granted to the 01 commission by this chapter, AS 14.43, AS 14.44, or AS 14.48, except its power to 02 adopt regulations and its duty to consider appeals under AS 14.43.100(b) and 03 AS 14.48.120; 04 (3) establish task forces, committees, or subcommittees, not 05 necessarily consisting of commission members, to advise and assist the commission in 06 carrying out its functions; 07 (4) contract with or use existing institutions of postsecondary 08 education or other individuals or organizations to make studies, conduct surveys, 09 submit recommendations, or otherwise contribute to the work of the commission; 10 (5) establish fees for the review of an out-of-state institution that 11 (A) requests approval for participation in the programs under 12 AS 14.43.091 - 14.43.325, 14.43.510 - 14.43.750 [AS 14.43.091 - 14.43.750], 13 14.43.990, and AS 14.44; and 14 (B) is not accredited by a national or regional accreditation 15 association recognized by the Council for Higher Education Accreditation; 16 (6) collect all fees and costs incurred in collection of the amount owed 17 on a loan or repayment obligation if the loan or repayment obligation becomes 18 delinquent or in default; in this paragraph, fees and costs include attorney fees, court 19 costs, and collection fees charged by a collection agency; and 20 (7) if approved by the department, receive and analyze performance 21 data for students in grades kindergarten through 12 and enter into contracts for the 22 purpose of assessing education outcomes. 23  * Sec. 3. AS 14.43.810(a) is amended to read: 24 (a) The Alaska performance scholarship program is established to provide 25 scholarships for members of the high school graduating classes of 2017 and earlier 26 [GRADUATES] who are Alaska residents to attend a qualified postsecondary 27 institution in the state. 28  * Sec. 4. AS 14.43.820(a) is amended to read: 29 (a) Subject to appropriation, the commission shall award an Alaska 30 performance scholarship to an applicant who 31 (1) is a resident of the state as defined in AS 01.10.055; 01 (2) graduated or will graduate within six months from a high school in 02 the state; 03 (3) except as provided in (c) of this section, has completed a core 04 academic curriculum of high school level coursework that includes 05 (A) four years of mathematics, four years of language arts, four 06 years of science, and four years of social studies, one year of which may 07 include a foreign language, an Alaska Native language, fine arts, or cultural 08 heritage; or 09 (B) three years of mathematics, four years of language arts, 10 three years of science, four years of social studies, and two years of a foreign 11 language or an Alaska Native language; 12 (4) has a minimum grade-point average in high school of 2.5 or higher; 13 the department shall set by regulation minimum requirements based on a substantially 14 similar standard for districts that do not assign grades; 15 (5) has achieved a minimum score on a 16 (A) college entrance examination; or 17 (B) standardized examination designed to measure a student's 18 level of preparedness to make the transition to work, as selected by the 19 department; [AND] 20 (6) is enrolled in good standing in a course of study at a qualified 21 postsecondary institution in this state that is intended to result in the award of a 22 certificate or degree; and  23 (7) is determined eligible by the applicant's school district and  24 reported as eligible to the department not later than July 1, 2017. 25  * Sec. 5. AS 14.43.825(b) is amended to read: 26 (b) A student's eligibility for a scholarship terminates four [SIX] years after 27 the date the student graduates from high school unless the student qualifies for an 28 extension of time allowed by the department by regulation. The department may not  29 extend a student's eligibility for a scholarship past the 2020 - 2021 academic year. 30  * Sec. 6. AS 14.43.915(a) is amended to read: 31 (a) The Alaska education grant account is created as an account in the general 01 fund. Money may be appropriated to the account from the Alaska education  02 innovation grant [ALASKA HIGHER EDUCATION INVESTMENT] fund under 03 AS 37.14.750 and from other sources. The commission may use the money in the 04 account to pay grants awarded under AS 14.43.400 - 14.43.420 and to pay the cost of 05 administration of the Alaska education grant program created under AS 14.43.400. 06  * Sec. 7. AS 14.43.915(b) is amended to read: 07 (b) The Alaska performance scholarship award account is created as an 08 account in the general fund. Money may be appropriated to the account from the 09 Alaska education innovation grant [ALASKA HIGHER EDUCATION 10 INVESTMENT] fund under AS 37.14.750 and from other sources. The commission 11 may use the money in the account to pay scholarships awarded to students under 12 AS 14.43.810 - 14.43.849. 13  * Sec. 8. AS 14.43.915(c) is amended to read: 14 (c) Of the total amount available annually to the commission for payment of 15 grants under AS 14.43.400 - 14.43.420 and for payment of scholarships under 16 AS 14.43.810 - 14.43.849, one-third of the combined amount in the accounts 17 established under (a) and (b) of this section shall be available solely for payment of 18 grants awarded under AS 14.43.400 - 14.43.420. The commission shall annually 19 allocate to all qualified applicants for scholarships awarded under AS 14.43.810 - 20 14.43.849 two-thirds of the combined amount in the accounts. If an insufficient 21 number of qualified applicants are awarded grants under AS 14.43.400 - 14.43.420 or 22 scholarships under AS 14.43.810 - 14.43.849, or both, before the end of that fiscal 23 year, the commissioner shall redeposit the remaining funds into the Alaska education  24 innovation grant [ALASKA HIGHER EDUCATION INVESTMENT] fund 25 established under AS 37.14.750. 26  * Sec. 9. AS 14.45.130(a) is amended to read: 27 (a) A religious or other private school that elects to comply with AS 14.45.100 28 - 14.45.130 shall maintain permanent student records reflecting immunizations, 29 physical examinations, standardized testing, academic achievement, and courses taken 30 at the school [, AND LEVEL OF ELIGIBILITY FOR AN ALASKA 31 PERFORMANCE SCHOLARSHIP UNDER AS 14.43.810 - 14.43.849]. 01  * Sec. 10. AS 37.14.750(a) is amended to read: 02 (a) The Alaska education innovation grant [ALASKA HIGHER 03 EDUCATION INVESTMENT] fund is established in the general fund for the 04 purposes [PURPOSE] of making grants to school districts to support the Alaska  05 education innovation grant program under AS 14.03.128, making grants awarded 06 under AS 14.43.400 - 14.43.420 by appropriation to the account established under 07 AS 14.43.915(a), and [OF] making scholarship payments to qualified postsecondary 08 institutions for students under AS 14.43.810 - 14.43.849 by appropriation to the 09 account established under AS 14.43.915(b). Money in the fund does not lapse. The 10 fund consists of 11 (1) money appropriated to the fund; 12 (2) income earned on investment of fund assets; 13 (3) donations to the fund; and 14 (4) money redeposited under AS 14.43.915(c). 15  * Sec. 11. AS 37.14.750(a), as amended by sec. 10 of this Act, is amended to read: 16 (a) The Alaska education innovation grant fund is established in the general 17 fund for the purpose [PURPOSES] of making grants to school districts to support the 18 Alaska education innovation grant program under AS 14.03.128 [, MAKING 19 GRANTS AWARDED UNDER AS 14.43.400 - 14.43.420 BY APPROPRIATION 20 TO THE ACCOUNT ESTABLISHED UNDER AS 14.43.915(a), AND MAKING 21 SCHOLARSHIP PAYMENTS TO QUALIFIED POSTSECONDARY 22 INSTITUTIONS FOR STUDENTS UNDER AS 14.43.810 - 14.43.849 BY 23 APPROPRIATION TO THE ACCOUNT ESTABLISHED UNDER 24 AS 14.43.915(b)]. Money in the fund does not lapse. The fund consists of 25 (1) money appropriated to the fund; 26 (2) income earned on investment of fund assets; and 27 (3) donations to the fund [; AND 28 (4) MONEY REDEPOSITED UNDER AS 14.43.915(c)]. 29  * Sec. 12. AS 37.14.750(d) is amended to read: 30 (d) In this section, unless the context requires otherwise, "fund" means the 31 Alaska education innovation grant [ALASKA HIGHER EDUCATION 01 INVESTMENT] fund established in (a) of this section. 02  * Sec. 13. AS 43.20.014(a) is amended to read: 03 (a) A taxpayer is allowed a credit against the tax due under this chapter for 04 cash contributions accepted for 05 (1) direct instruction, research, and educational support purposes, 06 including library and museum acquisitions, and contributions to endowment, by an 07 Alaska university foundation, by a nonprofit, public or private, Alaska two-year or 08 four-year college accredited by a regional accreditation association, or by a public or 09 private nonprofit elementary or secondary school in the state; 10 (2) secondary school level vocational education courses, programs, and 11 facilities by a school district in the state; 12 (3) vocational education courses, programs, equipment, and facilities 13 by a state-operated vocational technical education and training school, a nonprofit 14 regional training center recognized by the Department of Labor and Workforce 15 Development, and an apprenticeship program in the state that is registered with the 16 United States Department of Labor under 29 U.S.C. 50 - 50b (National Apprenticeship 17 Act); 18 (4) a facility by a nonprofit, public or private, Alaska two-year or four- 19 year college accredited by a regional accreditation association or by a public or private 20 nonprofit elementary or secondary school in the state; 21 (5) Alaska Native cultural or heritage programs and educational 22 support, including mentoring and tutoring, provided by a nonprofit agency for public 23 school staff and for students who are in grades kindergarten through 12 in the state; 24 (6) education, research, rehabilitation, and facilities by an institution 25 that is located in the state and that qualifies as a coastal ecosystem learning center 26 under the Coastal America Partnership established by the federal government; 27 (7) the Alaska education innovation grant [ALASKA HIGHER 28 EDUCATION INVESTMENT] fund under AS 37.14.750; 29 (8) funding a scholarship awarded by a nonprofit organization to a 30 dual-credit student to defray the cost of a dual-credit course, including the cost of 31 (A) tuition and textbooks; 01 (B) registration, course, and programmatic student fees; 02 (C) on-campus room and board at the postsecondary institution 03 in the state that provides the dual-credit course; 04 (D) transportation costs to and from a residential school 05 approved by the Department of Education and Early Development under 06 AS 14.16.200 or the postsecondary school in the state that provides the dual- 07 credit course; and 08 (E) other related educational and programmatic costs; 09 (9) constructing, operating, or maintaining a residential housing 10 facility by a residential school in the state approved by the Department of Education 11 and Early Development under AS 14.16.200; 12 (10) childhood early learning and development programs and 13 educational support to childhood early learning and development programs provided 14 by a nonprofit corporation organized under AS 10.20, a tribal entity, or a school 15 district in the state, by the Department of Education and Early Development, or 16 through a state grant; 17 (11) science, technology, engineering, and math programs provided by 18 a nonprofit agency or a school district for school staff and for students in grades 19 kindergarten through 12 in the state; and 20 (12) the operation of a nonprofit organization dedicated to providing 21 educational opportunities that promote the legacy of public service contributions to the 22 state and perpetuate ongoing educational programs that foster public service 23 leadership for future generations of residents of the state. 24  * Sec. 14. AS 43.55.019(a) is amended to read: 25 (a) A producer of oil or gas is allowed a credit against the tax levied by 26 AS 43.55.011(e) for cash contributions accepted for 27 (1) direct instruction, research, and educational support purposes, 28 including library and museum acquisitions, and contributions to endowment, by an 29 Alaska university foundation or by a nonprofit, public or private, Alaska two-year or 30 four-year college accredited by a regional accreditation association; 31 (2) secondary school level vocational education courses, programs, and 01 facilities by a school district in the state; 02 (3) vocational education courses, programs, equipment, and facilities 03 by a state-operated vocational technical education and training school, a nonprofit 04 regional training center recognized by the Department of Labor and Workforce 05 Development, and an apprenticeship program in the state that is registered with the 06 United States Department of Labor under 29 U.S.C. 50 - 50b (National Apprenticeship 07 Act); 08 (4) a facility or an annual intercollegiate sports tournament by a 09 nonprofit, public or private, Alaska two-year or four-year college accredited by a 10 regional accreditation association; 11 (5) Alaska Native cultural or heritage programs and educational 12 support, including mentoring and tutoring, provided by a nonprofit agency for public 13 school staff and for students who are in grades kindergarten through 12 in the state; 14 (6) education, research, rehabilitation, and facilities by an institution 15 that is located in the state and that qualifies as a coastal ecosystem learning center 16 under the Coastal America Partnership established by the federal government; and 17 (7) the Alaska education innovation grant [ALASKA HIGHER 18 EDUCATION INVESTMENT] fund under AS 37.14.750. 19  * Sec. 15. AS 43.56.018(a) is amended to read: 20 (a) The owner of property taxable under this chapter is allowed a credit 21 against the tax due under this chapter for cash contributions accepted for 22 (1) direct instruction, research, and educational support purposes, 23 including library and museum acquisitions, and contributions to endowment, by an 24 Alaska university foundation or by a nonprofit, public or private, Alaska two-year or 25 four-year college accredited by a regional accreditation association; 26 (2) secondary school level vocational education courses, programs, and 27 facilities by a school district in the state; 28 (3) vocational education courses, programs, and facilities by a state- 29 operated vocational technical education and training school; 30 (4) a facility or an annual intercollegiate sports tournament by a 31 nonprofit, public or private, Alaska two-year or four-year college accredited by a 01 regional accreditation association; 02 (5) Alaska Native cultural or heritage programs and educational 03 support, including mentoring and tutoring, provided by a nonprofit agency for public 04 school staff and for students who are in grades kindergarten through 12 in the state; 05 (6) education, research, rehabilitation, and facilities by an institution 06 that is located in the state and that qualifies as a coastal ecosystem learning center 07 under the Coastal America Partnership established by the federal government; and 08 (7) the Alaska education innovation grant [ALASKA HIGHER 09 EDUCATION INVESTMENT] fund under AS 37.14.750. 10  * Sec. 16. AS 43.65.018(a) is amended to read: 11 (a) A person engaged in the business of mining in the state is allowed a credit 12 against the tax due under this chapter for cash contributions accepted for 13 (1) direct instruction, research, and educational support purposes, 14 including library and museum acquisitions, and contributions to endowment, by an 15 Alaska university foundation, by a nonprofit, public or private, Alaska two-year or 16 four-year college accredited by a regional accreditation association, or by a public or 17 private nonprofit elementary or secondary school in the state; 18 (2) secondary school level vocational education courses, programs, and 19 facilities by a school district in the state; 20 (3) vocational education courses, programs, and facilities by a state- 21 operated vocational technical education and training school; 22 (4) a facility by a nonprofit, public or private, Alaska two-year or four- 23 year college accredited by a regional accreditation association or by a public or private 24 nonprofit elementary or secondary school in the state; 25 (5) Alaska Native cultural or heritage programs and educational 26 support, including mentoring and tutoring, provided by a nonprofit agency for public 27 school staff and for students who are in grades kindergarten through 12 in the state; 28 (6) education, research, rehabilitation, and facilities by an institution 29 that is located in the state and that qualifies as a coastal ecosystem learning center 30 under the Coastal America Partnership established by the federal government; 31 (7) the Alaska education innovation grant [ALASKA HIGHER 01 EDUCATION INVESTMENT] fund under AS 37.14.750; 02 (8) funding a scholarship awarded by a nonprofit organization to a 03 dual-credit student to defray the cost of a dual-credit course, including the cost of 04 (A) tuition and textbooks; 05 (B) registration, course, and programmatic student fees; 06 (C) on-campus room and board at the postsecondary institution 07 in the state that provides the dual-credit course; 08 (D) transportation costs to and from a residential school 09 approved by the Department of Education and Early Development under 10 AS 14.16.200 or the postsecondary school in the state that provides the dual- 11 credit course; and 12 (E) other related educational and programmatic costs; 13 (9) constructing, operating, or maintaining a residential housing 14 facility by a residential school approved by the Department of Education and Early 15 Development under AS 14.16.200; 16 (10) childhood early learning and development programs and 17 educational support to childhood early learning and development programs provided 18 by a nonprofit corporation organized under AS 10.20, a tribal entity, or a school 19 district in the state, by the Department of Education and Early Development, or 20 through a state grant; 21 (11) science, technology, engineering, and math programs provided by 22 a nonprofit agency or a school district for school staff and for students in grades 23 kindergarten through 12 in the state; and 24 (12) the operation of a nonprofit organization dedicated to providing 25 educational opportunities that promote the legacy of public service contributions to the 26 state and perpetuate ongoing educational programs that foster public service 27 leadership for future generations of residents of the state. 28  * Sec. 17. AS 43.75.018(a) is amended to read: 29 (a) A person engaged in a fisheries business is allowed a credit against the tax 30 due under this chapter for cash contributions accepted for 31 (1) direct instruction, research, and educational support purposes, 01 including library and museum acquisitions, and contributions to endowment, by an 02 Alaska university foundation, by a nonprofit, public or private, Alaska two-year or 03 four-year college accredited by a regional accreditation association, or by a public or 04 private nonprofit elementary or secondary school in the state; 05 (2) secondary school level vocational education courses, programs, and 06 facilities by a school district in the state; 07 (3) vocational education courses, programs, and facilities by a state- 08 operated vocational technical education and training school; 09 (4) a facility by a nonprofit, public or private, Alaska two-year or four- 10 year college accredited by a regional accreditation association or by a public or private 11 nonprofit elementary or secondary school in the state; 12 (5) Alaska Native cultural or heritage programs and educational 13 support, including mentoring and tutoring, provided by a nonprofit agency for public 14 school staff and for students who are in grades kindergarten through 12 in the state; 15 (6) education, research, rehabilitation, and facilities by an institution 16 that is located in the state and that qualifies as a coastal ecosystem learning center 17 under the Coastal America Partnership established by the federal government; 18 (7) the Alaska education innovation grant [ALASKA HIGHER 19 EDUCATION INVESTMENT] fund under AS 37.14.750; 20 (8) funding a scholarship awarded by a nonprofit organization to a 21 dual-credit student to defray the cost of a dual-credit course, including the cost of 22 (A) tuition and textbooks; 23 (B) registration, course, and programmatic student fees; 24 (C) on-campus room and board at the postsecondary institution 25 in the state that provides the dual-credit course; 26 (D) transportation costs to and from a residential school 27 approved by the Department of Education and Early Development under 28 AS 14.16.200 or the postsecondary school in the state that provides the dual- 29 credit course; and 30 (E) other related educational and programmatic costs; 31 (9) constructing, operating, or maintaining a residential housing 01 facility by a residential school approved by the Department of Education and Early 02 Development under AS 14.16.200; 03 (10) childhood early learning and development programs and 04 educational support to childhood early learning and development programs provided 05 by a nonprofit corporation organized under AS 10.20, a tribal entity, or a school 06 district in the state, by the Department of Education and Early Development, or 07 through a state grant; 08 (11) science, technology, engineering, and math programs provided by 09 a nonprofit agency or a school district for school staff and for students in grades 10 kindergarten through 12 in the state; and 11 (12) the operation of a nonprofit organization dedicated to providing 12 educational opportunities that promote the legacy of public service contributions to the 13 state and perpetuate ongoing educational programs that foster public service 14 leadership for future generations of residents of the state. 15  * Sec. 18. AS 43.77.045(a) is amended to read: 16 (a) In addition to the credit allowed under AS 43.77.040, a person engaged in 17 a floating fisheries business is allowed a credit against the tax due under this chapter 18 for cash contributions accepted for 19 (1) direct instruction, research, and educational support purposes, 20 including library and museum acquisitions, and contributions to endowment, by an 21 Alaska university foundation, by a nonprofit, public or private, Alaska two-year or 22 four-year college accredited by a regional accreditation association, or by a public or 23 private nonprofit elementary or secondary school in the state; 24 (2) secondary school level vocational education courses, programs, and 25 facilities by a school district in the state; 26 (3) vocational education courses, programs, and facilities by a state- 27 operated vocational technical education and training school; 28 (4) a facility by a nonprofit, public or private, Alaska two-year or four- 29 year college accredited by a regional accreditation association or by a public or private 30 nonprofit elementary or secondary school in the state; 31 (5) Alaska Native cultural or heritage programs and educational 01 support, including mentoring and tutoring, provided by a nonprofit agency for public 02 school staff and for students who are in grades kindergarten through 12 in the state; 03 (6) education, research, rehabilitation, and facilities by an institution 04 that is located in the state and that qualifies as a coastal ecosystem learning center 05 under the Coastal America Partnership established by the federal government; 06 (7) the Alaska education innovation grant [ALASKA HIGHER 07 EDUCATION INVESTMENT] fund under AS 37.14.750; 08 (8) funding a scholarship awarded by a nonprofit organization to a 09 dual-credit student to defray the cost of a dual-credit course, including the cost of 10 (A) tuition and textbooks; 11 (B) registration, course, and programmatic student fees; 12 (C) on-campus room and board at the postsecondary institution 13 in the state that provides the dual-credit course; 14 (D) transportation costs to and from a residential school 15 approved by the Department of Education and Early Development under 16 AS 14.16.200 or the postsecondary school in the state that provides the dual- 17 credit course; and 18 (E) other related educational and programmatic costs; 19 (9) constructing, operating, or maintaining a residential housing 20 facility by a residential school approved by the Department of Education and Early 21 Development under AS 14.16.200; 22 (10) childhood early learning and development programs and 23 educational support to childhood early learning and development programs provided 24 by a nonprofit corporation organized under AS 10.20, a tribal entity, or a school 25 district in the state, by the Department of Education and Early Development, or 26 through a state grant; 27 (11) science, technology, engineering, and math programs provided by 28 a nonprofit agency or a school district for school staff and for students in grades 29 kindergarten through 12 in the state; and 30 (12) the operation of a nonprofit organization dedicated to providing 31 educational opportunities that promote the legacy of public service contributions to the 01 state and perpetuate ongoing educational programs that foster public service 02 leadership for future generations of residents of the state. 03  * Sec. 19. AS 14.03.113 is repealed July 1, 2017. 04  * Sec. 20. AS 14.43.400, 14.43.405, 14.43.406, 14.43.415, 14.43.420, 14.43.810, 14.43.820, 05 14.43.825, 14.43.830, 14.43.840, 14.43.849, 14.43.915; and AS 37.14.750(c) are repealed 06 February 1, 2021. 07  * Sec. 21. The uncodified law of the State of Alaska is amended by adding a new section to 08 read: 09 APPLICABILITY. (a) The Alaska Commission on Postsecondary Education may only 10 award an Alaska performance scholarship under AS 14.43.810 - 14.43.849 to a new applicant 11 if the applicant is determined eligible by the applicant's school district and reported as eligible 12 to the Department of Education and Early Development on or before July 1, 2017. 13 (b) In this section, "school district" has the meaning given in AS 14.43.849. 14  * Sec. 22. The uncodified law of the State of Alaska is amended by adding a new section to 15 read: 16 TRANSITION: REGULATIONS. The Department of Education and Early 17 Development, the Department of Labor and Workforce Development, and the Alaska 18 Commission on Postsecondary Education may adopt regulations necessary to implement 19 changes made to their respective authorities by this Act. The regulations take effect under 20 AS 44.62 (Administrative Procedure Act), but not before the effective date of the law being 21 implemented. 22  * Sec. 23. The uncodified law of the State of Alaska is amended by adding a new section to 23 read: 24 RETROACTIVITY. If secs. 3 - 5 and 19 of this Act take effect after July 1, 2017, 25 secs. 3 - 5 and 19 of this Act are retroactive to July 1, 2017. 26  * Sec. 24. Sections 2, 9, and 11 of this Act take effect February 1, 2021. 27  * Sec. 25. Except as provided in sec. 24 of this Act, this Act takes effect immediately under 28 AS 01.10.070(c).
