01 Extending the exemption from regulation by the Regulatory Commission of Alaska for certain                              
02 facilities or plants generating energy from renewable energy resources.

04    * Section 1. AS 42.05.711(r) is amended to read:                                                                   
05            (r)  A plant or facility that generates electricity entirely from renewable energy                           
06       resources is exempt from regulation under this chapter if                                                         
07                 (1)  the plant or facility                                                                              
08                      (A)  is first placed into commercial operation on or after                                         
09            August 31, 2010, and before July 1, 2021 [JANUARY 1, 2016]; and                                          
10                      (B)  does not generate more than 65 megawatts of electricity;                                      
11                 (2)  the electricity generated by the plant or facility is sold only to one                             
12       or more electric utilities that are regulated by the commission; and                                              
13                 (3)  the person that constructs, owns, acquires, or operates the plant or                               
01       facility has not received from the state                                                                          
02                      (A)  a grant that was used to generate the electricity from the                                    
03            renewable energy resources; or                                                                               
04                      (B)  a tax credit related to the generation of electricity from the                                
05            renewable energy resources.
