00 CS FOR SENATE BILL NO. 123(JUD) 01 "An Act relating to the bail forfeiture schedule and the penalty for the use of electronic 02 devices while driving; and providing for an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04  * Section 1. AS 28.05.151(b) is amended to read: 05 (b) The supreme court shall establish a scheduled amount of bail allowing 06 disposition of a citation for a violation of AS 28.05.095 and AS 28.35.161 that is  07 punishable as a violation without court appearance. 08  * Sec. 2. AS 28.35.161(f) is amended to read: 09 (f) A person who violates (a) of this section is guilty of 10 (1) a violation and shall be punished as provided in AS 12.55 11 [CLASS A MISDEMEANOR], unless any of the circumstances described in (2) - (4) 12 of this subsection apply; 13 (2) a class C felony if the person's driving causes physical injury to 14 another person; 01 (3) a class B felony if the person's driving causes serious physical 02 injury to another person; 03 (4) a class A felony if the person's driving causes the death of another 04 person. 05  * Sec. 3. The uncodified law of the State of Alaska is amended by adding a new section to 06 read: 07 APPLICABILITY. AS 28.35.161(f), as amended by sec. 2 of this Act, applies to 08 violations occurring on or after the effective date of this Act. 09  * Sec. 4. This Act takes effect July 1, 2016.
