00 CS FOR HOUSE BILL NO. 21(FIN) 01 "An Act relating to school terms; relating to years of service for teachers' retirement; 02 and providing for an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04  * Section 1. AS 14.03.030 is amended to read: 05 Sec. 14.03.030. School term. A school term begins and ends on the dates fixed 06 by the governing body of a school district. A school term shall include not less than 07 180 days in session unless, with the approval of the commissioner, 08 (1) a day used for in-service training of teachers is substituted for a day 09 in session, up to a maximum of 10 days; 10 (2) an "emergency closure day" is substituted for a day in session 11 because of conditions posing a threat to the health or safety of students; or 12 (3) the school board adopts an alternate [A DIFFERENT] school term 13 that includes at least 740 hours of instruction and study periods for pupils in 14 kindergarten, first grade, second grade, and third grade and at least 900 hours of 01 instruction and study periods for pupils in grades four through 12; if an alternate  02 school term is less than 172 days in session, the school board shall follow the  03 procedures in (b) of this section [IF THE COMMISSIONER FINDS THAT THE 04 SCHOOL BOARD HAS SUBMITTED AN ACCEPTABLE PLAN UNDER WHICH 05 STUDENTS WILL RECEIVE THE APPROXIMATE EDUCATIONAL 06 EQUIVALENT OF A 180-DAY TERM]. 07  * Sec. 2. AS 14.03.030 is amended by adding new subsections to read: 08 (b) Before a school board may adopt an alternate school term under (a)(3) of 09 this section that is less than 172 days in session, the school board shall first 10 demonstrate, to the satisfaction of the commissioner, that 11 (1) the students enrolled in the district will receive at least the 12 minimum hours of instruction and study periods required under (a)(3) of this section; 13 (2) the school board has involved affected students, teachers, and the 14 community in requesting an alternate school term that is less than 172 days in session; 15 and 16 (3) public comment on the alternate school term demonstrates majority 17 support for the alternate school term. 18 (c) Notwithstanding AS 39.35.300, the definition of "school year" in 19 AS 14.25.590, and the definitions of "year of service" in AS 14.25.220 and 14.25.590, 20 a teacher or noncertificated employee of a school district for an alternate school term 21 of less than 172 days under (b) of this section who has elected to have the employee's 22 years of public employees' retirement system service determined using the table of 23 service in AS 14.25.220 shall have the years of service for the alternate school term of 24 less than 172 days determined as follows: 25 (1) less than 15 days, no credit; 26 (2) 15 days or more but less than 30 days, 0.1 years; 27 (3) 30 days or more but less than 45 days, 0.2 years; 28 (4) 45 days or more but less than 60 days, 0.3 years; 29 (5) 60 days or more but less than 75 days, 0.4 years; 30 (6) 75 days or more but less than 90 days, 0.5 years; 31 (7) 90 days or more but less than 105 days, 0.6 years; 01 (8) 105 days or more but less than 120 days, 0.7 years; 02 (9) 120 days or more but less than 135 days, 0.8 years; 03 (10) 135 days or more but less than 150 days, 0.9 years; 04 (11) 150 days or more, 1.0 years. 05 (d) Part-time service of half time or more that is performed by an employee 06 whose year of service is determined under (c) of this section shall be credited in 07 proportion to the amount of credit that would have been received for service 08 performed on a full-time basis. 09  * Sec. 3. This Act takes effect July 1, 2014.
