00 CS FOR HOUSE BILL NO. 319(FIN) 01 "An Act relating to firearms; and providing for an effective date." 02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 03  * Section 1. AS 18.65.700(a) is amended to read: 04 (a) The department shall issue a permit to carry a concealed handgun to a 05 person who 06 (1) applies in person at an office of the Alaska State Troopers; 07 (2) qualifies under AS 18.65.705; 08 (3) submits on an [A COMPLETED] application [ON A] form 09 approved [PROVIDED] by the department [, THAT PROVIDES] the information 10 required under AS 18.65.705 and 18.65.710; [WITH EACH APPLICATION FORM 11 PROVIDED BY THE DEPARTMENT,] the department shall post on the  12 department's website [PROVIDE A COPY OF] the state laws and regulations 13 relating to concealed handguns, which must include a concise summary of where, 14 when, and by whom a handgun can be carried under state and federal law and shall,  15 on request, mail a copy of the regulations and summary to an applicant or  01 permittee; 02 (4) submits one complete set of fingerprints in the format approved by 03 the department that is of sufficient quality so that the fingerprints may be processed; 04 the fingerprints must be taken by a person, group, or agency approved by the 05 department; the department shall maintain a list of persons, groups, or agencies 06 approved to take fingerprints and shall provide the list to the public upon request; the 07 fingerprints shall be used to obtain a report of criminal justice information under 08 AS 12.62 and a national criminal history record check under AS 12.62.400; 09 (5) submits evidence of successful completion of a handgun course as 10 provided in AS 18.65.715; 11 (6) provides one frontal view color photograph of the person taken 12 within the preceding 30 days that includes the head and shoulders of the person and is 13 of a size specified by the department; 14 (7) shows a valid Alaska driver's license or identification card at the 15 time of application; 16 (8) does not suffer a physical infirmity that prevents the safe handling 17 of a handgun; and 18 (9) pays the application fee required by AS 18.65.720. 19  * Sec. 2. AS 18.65.725(a) is amended to read: 20 (a) A permittee shall apply for renewal of a permit to carry a concealed 21 handgun within 90 days before the expiration of the permit, on a [AND SHALL 22 PRESENT A COMPLETE] renewal form approved [PROVIDED] by the department. 23 The renewal form must include 24 (1) any change in the information originally submitted under 25 AS 18.65.710; 26 (2) a statement that the person remains qualified to receive and hold a 27 permit to carry a concealed handgun under AS 18.65.705; 28 (3) one frontal view photograph of the person taken within the 29 preceding 30 days that includes the head and shoulders of the person and is of a size 30 specified by the department; 31 (4) the renewal fee required under AS 18.65.720; and 01 (5) the warning listed in AS 18.65.710(a)(6).  02  * Sec. 3. AS 18.65.725 is amended by adding new subsections to read: 03 (e) Notwithstanding AS 18.65.705(3), a permittee does not become ineligible 04 to hold a permit, and need not return or surrender a permit, when ceasing to be a 05 resident of the state, and the department may not require a permittee to return or 06 surrender a permit because a permittee ceases to be a resident of the state. However, a 07 permittee may not renew a permit if the permittee is not a resident of the state at the 08 time of renewal. 09 (f) The department shall mail the permittee a notice of expiration by first class 10 mail at least 90 days before expiration of the permit. 11  * Sec. 4. AS 18.65.760(a) is amended to read: 12 (a) The holder of a permit issued under AS 18.65.700 - 18.65.790 may not 13 (1) alter the permit; 14 (2) allow another person to use the permit; 15 (3) possess or display a suspended or revoked permit; or 16 (4) represent or display an expired permit as if the permit were  17 valid, unless the holder has submitted a complete, timely renewal form under 18 AS 18.65.725 and the renewal process has been delayed due to circumstances not 19 under the control of the applicant; this paragraph does not require a holder to  20 return or surrender a permit upon its expiration, nor may the department  21 require a holder to return or surrender a permit upon its expiration. 22  * Sec. 5. AS 18.65 is amended by adding a new section to article 11 to read: 23 Sec. 18.65.810. Execution of federal firearms forms. (a) The chief 24 administrative officer of a municipal police department for a person who resides in the 25 municipality and the head of the Alaska state troopers for a person who resides in the 26 state but does not reside in a municipality with a police department shall execute 27 within 30 days federal firearms forms required to be submitted by the person as a 28 transferee of a firearm if the person is qualified under state law to possess the firearm. 29 (b) In this section, "chief administrative officer" has the meaning given in 30 AS 18.65.290. 31  * Sec. 6. AS 18.65.725(f), added by sec. 3 of this Act, takes effect July 1, 2012.
