00 CS FOR HOUSE BILL NO. 228(L&C) 01 "An Act relating to fees for certain medical treatment and service under the Alaska 02 Workers' Compensation Act; and providing for an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04  * Section 1. AS 23.30.097(a) is amended to read: 05 (a) All fees and other charges for medical treatment or service are subject to 06 regulation by the board consistent with this section. A fee or other charge for medical 07 treatment or service may not exceed the lowest [LESSER] of 08 (1) the usual, customary, and reasonable fees for the treatment or 09 service in the community in which it is rendered, for treatment or service  10 (A) provided before August 1, 2007, not to exceed the fees in 11 the fee schedule specified by the board in its published bulletin dated 12 December 1, 2004; 13 (B) provided on or after August 1, 2007, but before  14 March 31, 2009, not to exceed the fees otherwise applicable in (A) of this  01 paragraph adjusted by the percentage change from 2004 to 2006 in the  02 medical care component of the Consumer Price Index for all urban  03 consumers compiled by the United States Department of Labor, Bureau of  04 Labor Statistics;  05 (2) the fee or charge for the treatment or service when provided to the 06 general public; or 07 (3) the fee or charge for the treatment or service negotiated by the 08 provider and the employer under (c) of this section. 09  * Sec. 2. Section 75, ch. 10, FSSLA 2005, is repealed. 10  * Sec. 3. The uncodified law of the State of Alaska is amended by adding a new section to 11 read: 12 TRANSITION: REGULATIONS. In accordance with AS 23.30.005, the Department 13 of Labor and Workforce Development may proceed to adopt regulations necessary to 14 implement the provisions of this Act. The regulations take effect under AS 44.62 15 (Administrative Procedure Act), but not before July 31, 2007. 16  * Sec. 4. Section 3 of this Act takes effect immediately under AS 01.10.070(c). 17  * Sec. 5. Except as provided in sec. 4 of this Act, this Act takes effect July 31, 2007.
