01 "An Act relating to brewery and brew pub licensing."                                                                    
02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
03    * Section 1.  AS 04.11.130(a) is amended to read:                                                                  
04            (a)  A brewery license authorizes the holder to operate a brewery where beer is                              
05       manufactured and packaged [BOTTLED OR BARRELED] for sale.                                                     
06    * Sec. 2.  AS 04.11.130(b) is amended to read:                                                                     
07            (b)  The holder of a brewery license may [SELL BEER IN QUANTITIES OF]                                        
08                 (1)  sell beer manufactured under the license in quantities of not                                  
09       more [LESS] than 16 [FIVE] gallons to an individual who is present on the licensed                        
10       premises;                                                                                                         
11                 (2)  sell beer manufactured under the license [MORE THAN FIVE                                       
12       GALLONS] to a person who is licensed under this title, or in another state or country;                        
13                 (3)  provide beer manufactured under the license for consumption                                    
14       on the licensed premises with or without charge unless prohibited under                                       
15       AS 04.16.030;                                                                                                 
01                 (4)  sell beer manufactured under the license in quantities of not                                  
02       more than five gallons a day to a person who is present on other licensed                                     
03       premises of the holder of the brewery license; however, the other licensed                                    
04       premises must be either a beverage dispensary license under AS 04.11.090 or a                                 
05       restaurant or eating place license under AS 04.11.100 and may not total more                                  
06       than two additional licensed premises in any combination.                                                     
07    * Sec. 3.  AS 04.11.450(b) is amended to read:                                                                     
08            (b)  A person who is a representative or owner of a wholesale business,                                      
09       [BREWERY,] winery, bottling works, or distillery may not be issued, solely or                                     
10       together with others, a beverage dispensary license, a restaurant or eating place                                 
11       license, or package store license.  A holder of a brewery [BEVERAGE                                           
12       DISPENSARY] license may be issued a beverage dispensary license or a                                          
13       restaurant or eating place [BREWPUB] license, subject to the provisions of                                    
14       AS 04.11.130 [AS 04.11.135.  THE PROHIBITION AGAINST ISSUANCE OF A                                            
15       RESTAURANT OR EATING PLACE LICENSE IMPOSED UNDER THIS                                                             
16       SUBSECTION DOES NOT APPLY TO A RESTAURANT OR EATING PLACE                                                         
17       LICENSE ISSUED ON OR BEFORE OCTOBER 1, 1996 OR A RESTAURANT OR                                                    
18       EATING PLACE LICENSE ISSUED UNDER AN APPLICATION FOR A                                                            
19       RESTAURANT OR EATING PLACE LICENSE APPROVED ON OR BEFORE                                                          
20       OCTOBER 1, 1996].                                                                                                 
21    * Sec. 4.  AS 04.11.080(19), 04.11.130(c), 04.11.135, and 04.11.360(10) are repealed.
