01 "An Act providing for the award of full actual attorney fees and costs to a person                                      
02 aggrieved by unlawful obstruction or hindrance of hunting, fishing, or viewing of fish or                               
03 game; amending Rules 79 and 82, Alaska Rules of Civil Procedure; and amending Rule                                      
04 508, Alaska Rules of Appellate Procedure."                                                                              
05 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
06    * Section 1.  AS 16.05.791(b) is amended to read:                                                                  
07            (b)  A person aggrieved by a violation of AS 16.05.790 is entitled to recover                                
08                 (1)  general damages and special damages, including license and permit                              
09       fees, travel costs, guide-outfitting fees, costs for special equipment and supplies, and                          
10       other related expenses; and                                                                                   
11                 (2)  full actual attorney fees and costs of an action to collect                                    
12       damages, fees, and costs under this subsection.                                                               
13    * Sec. 2.  The uncodified law of the State of Alaska is amended by adding a new section to                         
14 read:                                                                                                                   
01       INDIRECT COURT RULE CHANGE.  The provisions of AS 16.05.791(b), added by                                          
02 sec. 1 of this Act, have the effect of amending Rules 79 and 82, Alaska Rules of Civil                                  
03 Procedure, and Rule 508, Alaska Rules of Appellate Procedure, by providing for the award of                             
04 full actual attorney fees and costs to a person aggrieved by a violation of AS 16.05.790.                               
05    * Sec. 3.  The uncodified law of the State of Alaska is amended by adding a new section to                         
06 read:                                                                                                                   
07       CONDITIONAL EFFECT.  AS 16.05.791(b), added by sec. 1 of this Act, takes effect                                   
08 only if sec. 2 of this Act receives the two-thirds majority vote of each house required by art.                         
09 IV, sec. 15, Constitution of the State of Alaska.
