01 "An Act relating to permitting employers in the same trade to form joint insurance                                      
02 arrangements for self-insured workers' compensation coverage."                                                          
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
04    * Section 1.  AS 21.76.010 is amended by adding a new subsection to read:                                          
05            (e)  A group of five or more employers engaged in the same or similar                                        
06       classifications of employment may form an association to self-insure the obligations of                           
07       the employers in the association under AS 23.30 with a joint insurance arrangement if                             
08                 (1)  the association meets the standards for a certificate under                                        
09       AS 23.30.090; and                                                                                                 
10                 (2)  each employer that is a member of the self-insurance association is                                
11       a member or associate member of a qualified trade association; in this paragraph,                                 
12       "qualified trade association" means a trade association that                                                      
13                      (A)  is incorporated in this state;                                                                
14                      (B)  has been in existence for at least five years; and                                            
01                      (C)  has been organized and is maintained in good faith for                                        
02            purposes other than that of obtaining insurance.
