01 "An Act relating to applications for permanent fund dividends by certain individuals                                    
02 serving in the armed forces; and providing for an effective date."                                                      
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
04    * Section 1.  AS 43.23.011 is amended by adding a new subsection to read:                                          
05            (b)  Notwithstanding (a) of this section, an individual may apply for a                                      
06       permanent fund dividend during the period that begins January 2 and ends August 31                                
07       of that dividend year if the individual                                                                           
08                 (1)  was absent from the state at any time during the period that begins                                
09       January 2 and ends March 31 of that dividend year; and                                                            
10                 (2)  at any time while absent under (1) of this subsection,                                             
11                      (A)  served in active duty as a member of the armed forces of                                      
12            the United States; for purposes of this paragraph, "armed forces of the United                               
13            States" means the United States Army, Navy, Marine Corps, Air Force, or                                      
14            Coast Guard, the United States Army, Navy, Marine Forces, or Air Force                                       
01            Reserve, or the Alaska National Guard; and                                                                   
02                      (B)  was eligible for hostile fire or imminent danger pay.                                         
03    * Sec. 2.  The uncodified law of the State of Alaska is amended by adding a new section to                         
04 read:                                                                                                                   
05       RETROACTIVITY.  Section 1 of this Act is retroactive to January 2, 2004.                                          
06    * Sec. 3.  This Act takes effect immediately under AS 01.10.070(c).
