01 "An Act relating to the Chitina dip net fishery; and providing for an effective date."                                  
02 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
03    * Section 1.  AS 16.05.340(a)(22) is amended to read:                                                              
04                 (22)  Chitina dip net fishing permit ..................................... no fee [25               
05       A PERSON WHO HAS RECEIVED A PERMANENT IDENTIFICATION CARD                                                         
06       ISSUED UNDER AS 16.05.400(b) MAY OBTAIN A CHITINA DIP NET FISHING                                                 
07       PERMIT WITHOUT CHARGE.]  The members of the family of a person who has                                            
08       obtained a Chitina dip net fishing permit are not required to have a Chitina dip net                              
09       fishing permit while they are engaged in dip net fishing at Chitina if they are engaged                           
10       in fishing in the presence of the person and the person has the Chitina dip net fishing                           
11       permit in the person's physical possession. In this paragraph, "family" means persons                             
12       who are related by blood, marriage, or adoption and who live in the same household                                
13       on a permanent basis.  [THE LEGISLATURE MAY APPROPRIATE THE                                                       
14       RECEIPTS FROM THE SALE OF THE PERMIT TO THE FISH AND GAME                                                         
15       FUND.]                                                                                                            
01    * Sec. 2.  AS 16.10 is amended by adding a new section to read:                                                    
02                    Article 10A.  Chitina Dip Net Fishery.                                                             
03            Sec. 16.10.570.  Access to the Chitina dip net fishery.  (a)  The department                               
04       with the cooperation of the Department of Transportation and Public Facilities and the                            
05       Department of Natural Resources shall prepare a publication showing public access                                 
06       routes to fishing sites on public land for the Chitina dip net fishery.  The department                           
07       shall distribute the publication to persons who obtain a Chitina dip net fishing permit                           
08       and to the public.                                                                                                
09            (b)  The Department of Transportation and Public Facilities shall post and                                   
10       maintain permanent signs and notices showing the boundaries of public rights-of-way                               
11       that may be used to access fishing sites on public land for the Chitina dip net fishery.                          
12       The Department of Transportation and Public Facilities shall cooperate with the                                   
13       Department of Fish and Game in the preparation and production of the publication                                  
14       described in (a) of this section.                                                                                 
15            (c)  The Department of Natural Resources shall post and maintain permanent                                   
16       signs and notices showing the boundaries of state public land, and other land subject to                          
17       public easements and other interests in land, that may be used to access fishing sites                            
18       on public land for the Chitina dip net fishery.  The Department of Natural Resources                              
19       shall cooperate with the Department of Fish and Game in the preparation and                                       
20       production of the publication described in (a) of this section.                                                   
21    * Sec. 3.  This Act takes effect immediately under AS 01.10.070(c).
