00 HOUSE JOINT RESOLUTION NO. 36 01 Proposing an amendment to the Constitution of the State of Alaska relating to limiting 02 the rate of state income and sales and use taxes. 03 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04  * Section 1. Article IX, Constitution of the State of Alaska, is amended by adding a new 05 section to read: 06 Section 18. Tax Cap. (a) An income tax levied by the State shall be based 07 on a percentage of federal adjusted gross income and may not exceed a rate of five 08 percent of adjusted gross income as that term is defined in federal tax law. 09 (b) The rate of a sales or use tax levied by the State may not exceed five 10 percent of the sale price. This subsection does not limit the rate of a sales or use tax 11 levied by a municipality. 12  * Sec. 2. The amendment proposed by this resolution shall be placed before the voters of 13 the state at the next general election in conformity with art. XIII, sec. 1, Constitution of the 14 State of Alaska, and the election laws of the state.
