IX, sec. 17(c), Constitution of the State of 02 Alaska, from the constitutional budget reserve fund to the Alaska Industrial 03 Development and Export Authority for power projects and to fund the power cost 04 equalization and rural electric capitalization fund; and providing for an effective date." 05 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 06  * Section 1. ALASKA INDUSTRIAL DEVELOPMENT AND EXPORT AUTHORITY. 07 (a) The sum of $34,900,000 is appropriated from the constitutional budget reserve fund (art. 08 IX, sec. 17(c), Constitution of the State of Alaska) to the Alaska Industrial Development and 09 Export Authority, to fund the power transmission intertie fund (AS 44.83.550(a)). 10 (b) The sum of $32,400,000 is appropriated from the power transmission intertie fund 11 (AS 44.83.550(a)) to the Alaska Industrial Development and Export Authority, to be allocated 12 for the following purposes: 13 PURPOSE ALLOCATION 14 Payment as a no-interest loan under $12,000,000 01 AS 44.83.550 (power transmission intertie 02 loan program) to the Cordova Electric 03 Association for completion of the Power Creek 04 hydroelectric project 05 Payment as a no-interest loan under 12,000,000 06 AS 44.83.550 (power transmission intertie 07 loan program) to Copper Valley Electric 08 Association to pay capital construction debt 09 Payment as a no-interest loan under AS 44.83.550 8,400,000 10 (power transmission intertie loan program) 11 to Alaska Power and Telephone Company for the 12 acquisition, design, and construction of a power 13 transmission intertie between Tok and Chistochina 14  * Sec. 2. The sum of $60,800,000 is appropriated from the constitutional budget reserve 15 fund (art. IX, sec. 17(c), Constitution of the State of Alaska) to the Department of Community 16 and Economic Development, Alaska Industrial Development and Export Authority, to be 17 allocated for the following purposes: 18 PURPOSE ALLOCATION 19 Payment as a grant under AS 37.05.316 to Matanuska 2,500,000 20 Electric Association for construction of a three-phase 21 power line from Mile 100 to Mile 133 of the 22 Parks Highway 23 Payment as a grant under AS 37.05.316 to the Homer 4,800,000 24 Electric Association for the Seldovia/Port Graham/ 25 Nanwalek regional power project 26 Extension of the Anchorage-Fairbanks power 24,500,000 27 transmission intertie and upgrade of the intertie 28 to 230 kilovolts 29 Payment as a grant under AS 37.05.316 to Copper 500,000 30 Valley Electric Association for an intertie study 31 Payment as a grant under AS 37.05.316 to Anchorage 25,000,000 01 Municipal Light and Power on behalf of the Eklutna 02 operating committee for replacing the Eklutna 03 project power transmission line 04 Preconstruction studies of a power transmission intertie 1,000,000 05 between Petersburg and Kake 06 Preconstruction studies of a power transmission intertie 1,000,000 07 between Kake and Sitka 08 Preconstruction studies of a power transmission intertie 1,000,000 09 between Juneau and Hoonah 10 Study of the entire electrical grid for Southeast Alaska 500,000 11  * Sec. 3. POWER COST EQUALIZATION AND RURAL ELECTRIC 12 CAPITALIZATION FUND. The sum of $7,800,000 is appropriated from the constitutional 13 budget reserve fund (art. IX, sec. 17(c), Constitution of the State of Alaska) to the power cost 14 equalization and rural electric capitalization fund (AS 42.45.100) for the power cost 15 equalization program for the fiscal year ending June 30, 2002. 16  * Sec. 4. CONSTITUTIONAL BUDGET RESERVE FUND. The appropriations made by 17 secs. 1(a), 2, and 3 of this Act are made under art. IX, sec. 17(c), Constitution of the State of 18 Alaska. 19  * Sec. 5. LAPSE PROVISIONS. (a) The appropriations made by secs. 1(b) and 2 of this 20 Act are for capital projects, lapse under AS 37.25.020, and lapse into the constitutional budget 21 reserve fund (art. IX, sec. 17(c), Constitution of the State of Alaska). 22 (b) The appropriations made by secs. 1(a) and 3 of this Act are to capitalize funds and 23 do not lapse. 24  * Sec. 6. CONTINGENT EFFECT. This Act takes effect only if the Twenty-Second 25 Alaska State Legislature passes an Act that establishes a power transmission intertie fund and 26 that Act becomes law. 27  * Sec. 7. If this Act takes effect under sec. 6 of this Act, it takes effect immediately under 28 AS 01.10.070(c).
