00 SENATE BILL NO. 356 am 01 "An Act relating to regulation of candidates for state office; and providing for 02 an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 15.13.072(d) is amended to read: 05  (d) A candidate or an individual who has filed with the commission the 06 document necessary to permit that individual to incur election-related expenses under 07 AS 15.13.100 for election or reelection to the state legislature may not solicit or accept 08 a contribution while the legislature is convened in a regular or special legislative 09 session unless the solicitation or acceptance occurs 10   (1) during the 90 days immediately preceding an election in which the 11 candidate or individual is a candidate ; and 12  (2) in a place other than the capital city . 13 * Sec. 2. AS 15.13.072 is amended by adding a new subsection to read: 14  (g) A candidate or an individual who has filed with the commission the 01 document necessary to permit that individual to incur election-related expenses under 02 AS 15.13.100 for election or reelection to the office of governor or lieutenant governor 03 may not solicit or accept a contribution in the capital city while the legislature is 04 convened in a regular or special legislative session. 05 * Sec. 3. AS 15.13.074(c) is amended to read: 06  (c) A person or group may not make a contribution 07  (1) to a candidate for governor or lieutenant governor or an individual 08 who files with the commission the document necessary to permit that individual to 09 incur certain election-related expenses as authorized by AS 15.13.100 for governor or 10 lieutenant governor [,] before the later of the following dates: 11  (A) the date the individual 12  (i) becomes a candidate; or 13  (ii) files with the commission the document necessary 14 to permit the individual to incur certain election-related expenses 15 as authorized by AS 15.13.100; or 16  (B) January 1 of the year of the election  when the office is to 17 be filled at a general election; or 18  (C) the date of the proclamation when the office is to be 19 filled at a special election ; 20  (2) to a candidate for the state legislature or an individual who files 21 with the commission the document necessary to permit that individual to incur certain 22 election-related expenses as authorized by AS 15.13.100 for the state legislature while 23 the legislature is convened in a regular or special legislative session, unless the 24 contribution is made  in a place other than the capital city during the 90 days 25 immediately preceding an election in which the candidate or individual is a candidate, 26 or before the later of the following dates: 27  (A) the date the individual 28  (i) becomes a candidate; or 29  (ii) files with the commission the document necessary 30 to permit the individual to incur certain election-related expenses as 31 authorized by AS 15.13.100; or 01  (B) January 1 of the year of the election; 02  (3) to a candidate or an individual who files with the commission the 03 document necessary to permit that individual to incur certain election-related expenses 04 as authorized by AS 15.13.100 for an office that is to be filled at a municipal election 05 before the later of the following dates: 06  (A) the date the individual 07  (i) becomes a candidate; or 08  (ii) files with the commission the document necessary 09 to permit that individual to incur certain election-related expenses as 10 authorized by AS 15.13.100; 11  (B)  the date that is nine months before the date of the 12 municipal election; or 13  (4) to any candidate later than the 45th day 14  (A) after the date of a primary election if the candidate 15  (i) has been nominated at the primary election or is 16 running as a write-in candidate; and 17  (ii) is not opposed at the general election; 18  (B) after the date of the primary election if the candidate was not 19 nominated at the primary election; or 20  (C) after the date of the general election, or after the date of a 21 municipal or municipal runoff election, if the candidate was opposed at the 22 general, municipal, or municipal runoff election ;  23   (5) in the capital city to a candidate for governor or lieutenant 24 governor or the state legislature when the legislature is convened in a regular or 25 special legislative session . 26 * Sec. 4. AS 24.60.031(a) is amended to read: 27  (a) A legislator or legislative employee may not 28  (1)  on a day when either house of  [WHILE] the legislature is in 29 regular or special session, solicit or accept a contribution or a promise or pledge to 30 make a contribution for a  campaign for the state legislature; however, a legislator 31 may, except in the capital city, solicit or accept a contribution, promise, or pledge 01 for a campaign for the state legislature that occurs during the 90 days 02 immediately preceding an election in which the legislator is a candidate for the 03 state legislature  [STATE LEGISLATIVE CAMPAIGN]; 04  (2) accept money from an event held  on a day when either house of 05 the legislature is in regular or special  [DURING A LEGISLATIVE] session if a 06 substantial purpose of the event is [EITHER] to raise money on behalf of the member 07 or legislative employee for [CAMPAIGN PURPOSES OR TO RAISE MONEY FOR] 08 state legislative political purposes;  however, this paragraph does not prohibit a 09 legislator from accepting money from an event held in a place other than the 10 capital city, during the 90 days immediately preceding an election in which the 11 legislator is a candidate for the state legislature; or 12  (3)  in a campaign for the state legislature, expend money  that was 13 raised on a day when either house of the legislature was in a [STATE] legislative 14  session  [CAMPAIGN THAT WAS RAISED] by or on behalf of a legislator [DURING 15 A LEGISLATIVE SESSION] under  a declaration of candidacy or a general letter of 16 intent to become a candidate for public office ; however, this paragraph does not 17 apply to money raised in a place other than the capital city during the 90 days 18 immediately preceding an election in which the legislator is a candidate for the 19 state legislature . 20 * Sec. 5. This Act takes effect immediately under AS 01.10.070(c).
