00 CS FOR HOUSE BILL NO. 125(JUD) 01 "An Act relating to disclosures to school officials of information about certain 02 minors; and providing for an effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 47.10.093(a) is amended to read: 05  (a) Except as specified in AS 47.10.092 and (b) - (f) and (h) of this section, 06 all information and social records pertaining to a minor who is subject to this chapter 07 or AS 47.17 prepared by or in the possession of a federal, state, or municipal agency 08 or employee in the discharge of the agency's or employee's official duty, including 09 driver's license actions under AS 28.15.185, are privileged and may not be disclosed 10 directly or indirectly to anyone without a court order. 11 * Sec. 2. AS 47.10.093 is amended by adding new subsections to read: 12  (h) The department and affected law enforcement agencies shall work with 13 school districts and private schools to develop procedures for the disclosure of 14 information to school officials under (b)(3) and (c)(3) of this section. The procedures 01 must provide a method for informing the principal or the principal's designee of the 02 school the student attends as soon as it is reasonably practicable. 03  (i) Notwithstanding (c)(3) of this section, a state or municipal law enforcement 04 agency is not required to notify the appropriate school official of a school district or 05 school under (c) of this section if the agency determines that notice would jeopardize 06 an ongoing investigation. 07  (j) In this section, "school" means a public or private elementary or secondary 08 school. 09 * Sec. 3. TIME DEADLINE FOR DEVELOPMENT OF PROCEDURES AFFECTING 10 SCHOOL DISTRICTS. The procedures required by AS 47.10.093(h), added by sec. 2 of this 11 Act, shall be developed not later than 90 days after the effective date of this Act. 12 * Sec. 4. This Act takes effect immediately under AS 01.10.070(c).
