00 HOUSE BILL NO. 82 01 "An Act relating to the public school foundation program; and providing for an 02 effective date." 03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 04 * Section 1. AS 14.17.025(a) is amended to read: 05  (a) Local contributions to a city or borough school district shall include at least 06 the lesser of 07  (1) the equivalent of a five [FOUR] mill tax levy on the full and true 08 value of the taxable real and personal property in the district as of January 1 of the 09 second preceding fiscal year, as determined by the Department of Community and 10 Regional Affairs under AS 14.17.140 and AS 29.45.110; or 11  (2) 35 percent of the district's basic need for the preceding fiscal year, 12 as determined under AS 14.17.021(b). 13 * Sec. 2. AS 14.17.025(b) is amended to read: 14  (b) In addition to the local contributions required under (a) of this section, 01 local contributions to a city or borough school district in a fiscal year may include no 02 more than the greater of 03  (1) the equivalent of a two mill tax levy on the full and true value of 04 the taxable real and personal property in the district as of January 1 of the second 05 preceding fiscal year, as determined by the Department of Community and Regional 06 Affairs under AS 14.17.140 and AS 29.45.110; or 07  (2) 19 [23] percent of the district's basic need for the fiscal year under 08 AS 14.17.021(b), as adjusted under AS 14.17.225(b). 09 * Sec. 3. AS 14.17.025(c) is amended to read: 10  (c) The department may by regulation reduce the maximum local contribution 11 specified in (b) of this section if necessary to keep revenue or expenditure disparities 12 among school districts in the state in compliance with federal equalization requirements 13 under sec. 8009 of P. L. 103-382 (Improving America's Schools Act)  [SEC. 5(d) 14 - (2) OF P.L. 81-874 (20 U.S.C. 240(d)(2)), AS AMENDED, AND REGULATIONS 15 ADOPTED UNDER IT] . 16 * Sec. 4. AS 14.17.041(b) is amended to read: 17  (b) For funding communities that are not included under (a) of this section, 18  (1) instructional units for elementary students are determined by the 19 formula: units = 15 + ((ADM-200)/16) [15 + ((ADM-200)/17)], where ADM is the 20 number of students in average daily membership in grades kindergarten through 6; 21  (2) instructional units for secondary students are determined by the 22 formula: units = 18 + ((ADM-200)/13), where ADM is the number of students in 23 average daily membership in grades 7 through 12. 24 * Sec. 5. AS 14.17.041 is amended by adding a new subsection to read: 25  (e) A district with an ADM of 850 or less that consists of one funding 26 community shall increase the elementary and secondary instructional units received 27 under (a) or (b) of this section by multiplying the instructional units by a percentage 28 determined under the following table: 29 District ADM Percentage 30 1 - 250 1.12 31 251 - 525 1.08 01 526 - 850 1.06. 02 * Sec. 6. AS 14.17.056 is amended to read: 03  Sec. 14.17.056. INSTRUCTIONAL UNIT VALUE. The instructional unit 04 value is $63,500 [$61,000] . 05 * Sec. 7. This Act takes effect July 1, 1995.
