00 CS FOR SENATE BILL NO. 275(TRA)                                                                                         
01 "An Act relating to the disposal of real property by the Department of                                                  
02 Transportation and Public Facilities."                                                                                  
03 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
04    * Section 1.  AS 38.05.030(d) is amended to read:                                                                    
05  (d)  Except for land that is required to be returned to the department                                               
06 under (b) of this section, [REAL PROPERTY ACQUIRED BY AND UNDER THE                                                    
07 MANAGEMENT OF THE AGENCIES REFERRED TO IN (b) OF THIS SECTION                                                           
08 THAT IS NO LONGER NEEDED FOR ITS INTENDED USE SHALL BE                                                                  
09 TRANSFERRED TO THE COMMISSIONER, EXCEPT THAT] the Department of                                                         
10 Transportation and Public Facilities may dispose of real property acquired by it under                                  
11 AS 02.15.070, AS 19.05.040(1) and (2), [AS 19.05.040(2) AND] 19.05.080 -                                              
12 19.05.120, AS 35.05.040(1) and (2), and AS 35.20.010 - 35.20.050.  Land conveyed                                       
13 under this section to a municipality shall be credited against the municipality's                                       
14 entitlement under AS 29.65, unless the land is conveyed in consideration for other                                      
01 land required for state purposes.
