00 SENATE BILL NO. 266 01 "An Act extending the termination date of the Board of Certified Direct-Entry 02 Midwives; relating to the scope of practice of certified direct-entry midwives; and 03 providing for an effective date." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. AS 08.03.010(c)(6) is amended to read: 06  (6) Board of Certified Direct-Entry Midwives (AS 08.65.010) - June 30, 07 1998 [1994]; 08 * Sec. 2. AS 08.65.140(a) is amended to read: 09  (a) Except as provided in regulations adopted under (g) [(d)] of this section, 10 a certified direct-entry midwife may not assume the care or delivery of a client unless 11 the certified direct-entry midwife has recommended that the client undergo a physical 12 examination performed by a physician, physician assistant, advanced nurse practitioner, 13 or certified nurse midwife, who is licensed in this state. 14 * Sec. 3. AS 08.65.140 is amended by adding a new subsection to read: 01  (g) The board shall adopt regulations that specify the conditions under which 02 a certified direct-entry midwife may not knowingly deliver a woman. The regulations 03 may provide for exceptions to the general prohibitions contained in the regulations. 04 * Sec. 4. AS 08.65.140(d), 08.65.140(e), and 08.65.140(f) are repealed. 05 * Sec. 5. Sections 1 and 3 of this Act take effect immediately under AS 01.10.070(c). 06 * Sec. 6. Sections 2 and 4 of this Act take effect on the effective date of regulations 07 adopted under AS 08.65.140(g), added by sec. 3 of this Act. The Board of Certified Direct-Entry Midwives shall 08 notify the revisor of statutes of the effective date of those regulations.
