00 CONFERENCE CS FOR SENATE BILL NO. 165 01 "An Act making an appropriation to the Alyeska Settlement Fund and making 02 appropriations from the Alyeska Settlement Fund; making, amending, and repealing 03 operating and capital appropriations; and providing for an effective date." 04 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA: 05 * Section 1. The interest of the State of Alaska in payments received by the state for 06 deposit into the Alyeska Settlement Fund under the Agreement and Consent Decree in IN RE: 07 The EXXON VALDEZ, United States District Court, District of Alaska, case No. A89-095 08 Civil (Consolidated)(Re: case No. A92-175 Civil, decree entered November 25, 1992), is 09 appropriated to the Alyeska Settlement Fund. 10 * Sec. 2. The sum of $20,500,000 is appropriated from the Alyeska Settlement Fund to the 11 Department of Transportation and Public Facilities and is allocated for the following projects 12 in the amounts listed: 13 PROJECT ALLOCATION 14 Construction of oil spill response equipment 01 storage facilities and docks at Tatitlek 02 and Chenega; acquisition of oil spill 03 response equipment for prepositioning at Tatitlek 04 and Chenega $14,500,000 05 Construction of road from Cordova to 06 Shepard Point; construction of oil spill response 07 equipment storage facilities at Shepard Point; 08 acquisition of oil spill response equipment for 09 prepositioning at Shepard Point 6,000,000 10 * Sec. 3. The sum of $7,500,000 is appropriated from the Alyeska Settlement Fund to the 11 Department of Natural Resources for the purchase of the inholdings of the Seldovia Native 12 Association and of the Timber Trading Company, within the Kachemak Bay State Park as 13 identified in the Preliminary Exchange Agreement dated June 30, 1989, as amended as of the 14 effective date of this Act, between the state, the Seldovia Native Association, and the Timber 15 Trading Company; and for the purchase of the inholdings of the Cook Inlet Region, Inc., 16 within Kachemak Bay State Park. 17 * Sec. 4. The sum of $200,000 is appropriated from the Alyeska Settlement Fund to the 18 Department of Environmental Conservation for the acquisition and installation of 19 communications equipment at the Valdez Emergency Operations Center. 20 * Sec. 5. In secs. 1 - 5 of this Act, "Alyeska Settlement Fund" means the trust fund 21 established in the state treasury for the purpose of receiving, holding, and disbursing the 22 settlement proceeds received by the state under the Agreement and Consent Decree in IN RE: 23 The EXXON VALDEZ, United States District Court, District of Alaska, case No. A89-095 24 Civil (Consolidated)(Re: case No. A92-175 Civil, decree entered November 25, 1992). 25 * Sec. 6. The unexpended and unobligated balance, not to exceed $250,000, of the 26 appropriation made in sec. 146(a), ch. 96, SLA 1991, as amended by sec. 54, ch. 5, FSSLA 27 1992, (national education effort for opening the Arctic National Wildlife Refuge - $3,000,000) 28 is repealed and reappropriated to the Office of the Governor for payment as a grant under 29 AS 37.05.316 to Arctic Power, Inc., for promotion of the opening of the Arctic National 30 Wildlife Refuge to oil and gas development. 31 * Sec. 7. The unexpended and unobligated balance of that portion of the appropriation 16 made by sec. 201(b), ch. 117, SLA 1989 that is allocated in sec. 201(b)(2) (City of New 17 Stuyahok - $79,142) is repealed and reappropriated to the Department of Administration for 18 payment as a grant under AS 37.05.315 to the City of New Stuyahok for repairs and 19 improvements to the community building. 20 * Sec. 53. (a) The unexpended and unobligated balance of that portion of the appropriation 21 made in sec. 1, ch. 5, SLA 1991, that is allocated on page 2, line 3, (Pupil transportation - 22 $28,572,000) that lapses June 30, 1993, is appropriated to the Department of Education and 23 is allocated for the following purposes in the amounts listed: 24 PURPOSE AMOUNT 25 Fund for the improvement of 26 school performance (AS 14.03.125) $520,668 27 Pupil transportation 520,668 28 (b) If the amount lapsing from the appropriation and allocation referenced in (a) of 29 this section is less than $1,041,336, then the allocations made by (a) of this section shall be 30 reduced in proportion to the amount of the shortfall. 31 (c) The appropriation made by this section lapses June 30, 1994. 01 * Sec. 54. The unexpended and unobligated balance of the disaster relief fund 02 (AS 26.23.300) on June 30, 1993, lapses into the funds from which it was appropriated 03 June 30, 1994. 04 * Sec. 55. The expenditure, before July 1, 1992, by the Department of Community and 05 Regional Affairs of money appropriated to that department by sec. 128, ch. 5, FSSLA 1992, 06 for production of the Alcan Caravan Alaska Highway promotional film is ratified. 07 * Sec. 56. The unexpended and unobligated balance of that portion of the appropriation 08 made in sec. 152, ch. 5, FSSLA 1992, page 43, line 17, that is allocated on page 45, line 4 09 (Fireweed Lane upgrades - $1,584,000) is repealed. 10 * Sec. 57. The sum of $1,150,000 is appropriated from the general fund to the University 11 of Alaska to pay the settlement agreement and legal costs associated with Dix. et al., v. 12 University of Alaska (case No. 4FA-89-1910) for the fiscal year ending June 30, 1993. 13 * Sec. 58. The unexpended and unobligated balance, not to exceed $50,000, of that portion 14 of the appropriation made in sec. 40, ch. 73, SLA 1991, page 82, line 10 that is allocated on 15 page 82, line 21 (Council and subcommittees - $662,000), as amended by sec. 67, ch. 5, 16 FSSLA 1992, is reappropriated to the legislative council for legislative council operations for 17 the fiscal year ending June 30, 1994. 18 * Sec. 59. The unexpended and unobligated balance of the appropriation made in sec. 120, 19 ch. 173, SLA 1988 (Fairbanks North Star Borough - recreational rifle range project) is 20 repealed and reappropriated to the Department of Administration for payment as a grant under 21 AS 37.05.315 to the Fairbanks North Star Borough for the recreational rifle range project. 22 * Sec. 60. The appropriation made in sec. 165, ch. 96, SLA 1991, page 108, line 8 through 23 page 109, line 6 is amended to read: 24 APPROPRIATION GENERAL 25 ITEMS FUND 26 Municipality of Anchorage - Ship Creek 27 Redevelopment (ED 7 - 15) 5,500,000 5,500,000 28 The sum of $5,500,000 is appropriated to the 29 Municipality of Anchorage for access, tidelands fill and 30 utility upgrades for the Ship Creek Basin redevelopment 31 project, contingent upon a development agreement being 01 approved by both the Anchorage Economic Development 02 Corporation and the Alaska Railroad Corporation that 03 includes private investment commitments equal to or 04 exceeding this appropriation. 05 It is the intent of the legislature that this appropriation 06 be available for reappropriation if the required private investment 07 commitments have not been obtained [IT IS NOT ENCUMBERED BY 08 THE APPROVAL OF A DEVELOPMENT AGREEMENT BY BOTH THE 09 ANCHORAGE ECONOMIC DEVELOPMENT CORPORATION AND THE 10 ALASKA RAILROAD CORPORATION] by April 30, 1995 [1992]. It is also the 11 intent of the legislature that minority-owned and women-owned 12 businesses be encouraged to participate in and be employed in the 13 Ship Creek Basin project to the greatest extent feasible. 14  * Sec. 61. The unexpended and unobligated balance of that portion of the appropriation 15 made in sec. 139, ch. 208, SLA 1990, page 73, line 15 that is allocated on line 19 (Girdwood 16 Water Improvement District - $3,900,000) is reappropriated to the Department of 17 Administration for payment as a grant under AS 37.05.315 to the Municipality of Anchorage, 18 Anchorage water and wastewater utility, for the Alyeska Water Improvement District. 19 * Sec. 62. Contingent upon sec. 64 of this Act, all right, title, and interest in loans acquired 20 or made by the Department of Commerce and Economic Development and held by the tourism 21 revolving fund (AS 45.90.010), and interest in all mortgages, notes, and other instruments of 22 security made in connection with those loans are appropriated, on the effective date of this 23 section, to the enterprise development account (AS 44.88.155) of the Alaska Industrial 24 Development and Export Authority. 25 * Sec. 63. The sum of $90,600 is appropriated from the general fund to the Department 21 of Public Safety for increased personnel costs associated with criminal records and 22 identification to reduce backlogs for the fiscal year ending June 30, 1993. 23 * Sec. 143. The sum of $100,000 is appropriated from the general fund to the Department 24 of Public Safety for increased prisoner transport costs for the fiscal year ending June 30, 1993. 25 * Sec. 144. The sum of $48,500 is appropriated from the general fund to the Department 26 of Community and Regional Affairs for the fiscal year ending June 30, 1993, to repay the 27 United States Department of Labor for a 1989 Job Training Partnership Act grant to the 28 Kodiak Tribal Council that was disallowed by an administrative law judge. 29 * Sec. 145. The sum of $30,000 is appropriated from the general fund to the University 30 of Alaska Southeast, Sitka campus, for program planning for the Katlian Cooperative 31 Vocational School. 01 * Sec. 146. The sum of $297,700 is appropriated from the general fund to the Office of 02 the Governor, division of elections, for the fiscal year ending June 30, 1994, to implement the 03 reapportionment plan. 04 * Sec. 147. The unexpended and unobligated balance of the appropriation made in 05 sec. 165, ch. 96, SLA 1991, page 104, line 16 (Chester Creek Park design and construction - 06 $71,000) is repealed and reappropriated to the Department of Administration for payment as 07 a grant under AS 37.05.315 to the Municipality of Anchorage for Patterson Park 08 improvements. 09 * Sec. 148. The sum of $1,746,200 is appropriated from the general fund and federal funds 10 to the Department of Health and Social Services for implementation of the expansion of 11 Medicaid to severely disabled children in home and community-based care for the year ending 12 June 30, 1994. The sum of $15,000 is appropriated from the general fund to the Department 22 of Military and Veterans' Affairs for payment as a grant under AS 37.05.316 to the Women 23 In Military Service For America Memorial Foundation, Inc., for construction of the Women 24 In Military Service Memorial at Arlington National Cemetery. 25 * Sec. 150. The unexpended and unobligated balances of the appropriations made in sec. 26 604, ch. 130, SLA 1986 (Alaska Power Authority grant to City of Nikolai - $250,000); sec. 27 1, ch. 10, SLA 1988, page 6, line 14 (Alaska Power Authority Tatitlek electrification project - 28 $100,000); and sec. 162, ch. 173, SLA 1988, page 46, line 15 to the Alaska Power Authority 29 for rural electrification are repealed and reappropriated to the Alaska Energy Authority for 30 Snettisham acquisition. 31 * Sec. 151. Section 112 of this Act is retroactive to July 1, 1984. 01 * Sec. 152. Section 125 of this Act is retroactive to July 1, 1986. 02 * Sec. 153. The appropriations made by secs. 2 - 4, 22, 24, 27 - 33, 40, 42 - 44, 48, 51, 03 52, 59, 61, 66, 68, 128, and 147 of this Act are for capital projects and lapse under the 04 appropriate provision of law. 05 * Sec. 154. The unexpended and unobligated balances of the appropriations made by secs. 06 58, 129 - 131, 141, 145, 146, and 148 of this Act lapse into the fund from which they were 07 appropriated June 30, 1994. 08 * Sec. 155. The unexpended and unobligated balance of the appropriation made by sec. 67 09 of this Act lapses July 1, 1998. 10 * Sec. 156. Sections 1 - 11, 15, 16, 18 - 21, 41, 53 - 55, 57, 58 - 61, 65, 66, 68 - 145, and 11 149 - 154 of this Act take effect immediately under AS 01.10.070(c). 12 * Sec. 157. If secs. 62 and 63 of this Act take effect under sec. 64 of this Act, they take 13 effect on the effective date of a resolution adopted by the board of directors of the Alaska 14 Industrial Development and Export Authority authorizing the payment of $650,000 to the 15 general fund of the state from the assets of the authority to purchase the loan portfolio of the 16 tourism revolving loan fund established by AS 45.90.010. The executive director of the 17 authority shall notify the lieutenant governor and the revisor of statutes of the effective date 18 of the resolution. 19 * Sec. 158. Except as provided in secs. 155 and 156 of this Act, this Act takes effect 20 July 1, 1993.
