01 "An Act authorizing power transmission interties between Anchorage and the                                              
02 Kenai Peninsula, between Healy and Fairbanks, and between the Swan Lake and                                             
03 Tyee Lake hydroelectric projects, and approving the design and construction costs                                       
04 of the interties; and providing for an effective date."                                                                 
05 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:                                                                
06    * Section 1.  In accordance with AS 44.83.185(c) and contingent upon sec. 4 of this Act,                             
07 the Alaska Energy Authority is authorized to design and construct a 138 kilovolt power                                  
08 transmission intertie between Anchorage and the Kenai Peninsula at a cost of $84,100,000.                               
09 The transmission line shall be capable of being upgraded to 230 kilovolts.                                              
10    * Sec. 2.  In accordance with AS 44.83.185(c) and contingent upon sec. 4 of this Act, the                            
11 Alaska Energy Authority is authorized to design and construct a 138 kilovolt power                                      
12 transmission intertie between Healy and Fairbanks at a cost of $77,600,000.  The transmission                           
13 line shall be capable of being upgraded to 230 kilovolts.                                                               
14    * Sec. 3.  (a)  In accordance with AS 44.83.185(c), the Alaska Energy Authority is                                   
01 authorized to design and construct a 138 kilovolt power transmission intertie between the                               
02 Swan Lake and the Tyee Lake hydroelectric projects at a cost of $55,600,000.                                            
03  (b)  It is the intent of the legislature that the Alaska Energy Authority finance the                                  
04 design and construction of the intertie authorized by (a) of this section through the sale of                           
05 revenue bonds to be repaid from revenue from the sale of power from hydroelectric projects                              
06 included in the Four Dam Pool.                                                                                          
07    * Sec. 4.  The authorizations made by secs. 1 and 2 of this Act are contingent upon written                          
08 agreements between the Alaska Energy Authority and participating electric utilities providing                           
09 that the participating utilities agree to pay                                                                           
10   (1)  50 percent of the design and construction costs for the power transmission                                       
11 interties authorized by this Act; and                                                                                   
12   (2)  the operation and maintenance costs of the power transmission interties                                          
13 authorized by this Act.                                                                                                 
14    * Sec. 5.  This Act takes effect immediately under AS 01.10.070(c).
